Anina is a global marketplace offering a curated selection of products across various categories, including Clothing, Footwear, Accessories, Personal Care & Beauty, Home, Leisure, and Art. We believe that every product designed with care has a special customer waiting for it.

By accessing or using our website, anina.com (the "Website"), you agree to be bound by these Terms and Conditions ("Terms"). These Terms govern your access to and use of Anina's services, whether you are a buyer ("User") or a seller ("Brand"). If you do not agree to these Terms, you may not access or use the Website.

Platform Role

Aninagroup Inc. acts solely as an intermediary platform that connects buyers and independent sellers, Brands or Individuals. All sales are executed directly between the seller and the buyer. Aninagroup is not the seller of record for items sold on the platform. The seller is responsible for product fulfillment, returns, taxes and invoices to the buyer. Aninagroup Inc. only facilitates the transaction and charges a commission fee.

For Users (Buyers)

Account Registration:

To make purchases on Anina, you are required to register for an account. You can easily register using your email address. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

Use of Content:

All content featured on the Anina Website, including but not limited to text, graphics, logos, images, audio clips, video clips, data compilations, and software, is the property of Anina, its Brands, or its content suppliers and is protected by international copyright laws. As a User, you are granted a limited, non-exclusive, non-transferable, and revocable license to access and make personal, non-commercial use of the Website and its content.

This license does not include:

  • Any resale or commercial use of the Website or its content.
  • Any collection and use of product listings, descriptions, or prices.
  • Any derivative use of the Website or its content.
  • Any downloading or copying of account information for the benefit of another merchant.
  • Any use of data mining, robots, or similar data gathering and extraction tools.

You may not reproduce, duplicate, copy, sell, resell, visit, or otherwise exploit for any commercial purpose any portion of the Website without express written consent of Anina.

You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of Anina without express written consent.

Transactions:

All transactions on Anina are direct sales between the buyer and the Brand, facilitated by our platform. Anina directly handles the payment processing: we receive the payment from the buyer and then disburse it to the Brand, after deducting our commission.

Payments:

Payments for purchases made on Anina are processed securely through our platform. By making a purchase, you agree to the payment terms and conditions applicable to the transaction.

Returns and Refunds:

Each Brand on Anina maintains its own return and refund policy. Anina acts solely as a platform facilitator and does not directly manage or process returns or refunds for products sold by Brands. For the time being, the return function will not be available directly through the platform. In the future, the Brand will be responsible for managing returns, which will be initiated via a notice on the Website or a return order. We strongly encourage Users to carefully review the specific return and refund policy of each Brand before making a purchase.

Prohibited Conduct:

Users are strictly prohibited from engaging in any unlawful, fraudulent, or harmful activities on the Website, including but not limited to:

  • Fraudulent purchases or activities.
  • Spamming or sending unsolicited communications.
  • Using bots, crawlers, or any automated systems to access or interact with the Website.
  • Interfering with the operation of the Website or the experience of other users.

Customer Service (for Users):

Anina provides customer service for general account inquiries or any specific questions that cannot be resolved through our frequently asked questions. For product-specific inquiries or issues related to a specific order, please refer to the respective Brand's policies and contact information where applicable.

For Service Providers (Brands/Sellers)

Onboarding Process:

Anina welcomes all types of sellers, from individuals and groups to small, medium, and large brands. While we prefer to partner with brands that have an established product catalog, we also support new brands embarking on a new venture. We aim to help you pursue your dreams by generating sales and gaining recognition. To join Anina, Brands must complete our registration process and agree to adhere to these Terms.

Commissions and Payments:

Seller fees are as follows:

  • A 15% commission on the sold price of an item when it sells.

Payment Processing Fee: A 2.9% + 0.30 USD payment processing fee applies to the entire transaction (subtotal, tax, and shipping price paid by a buyer for a given order). This fee is not currently applied to any international shipping/taxes.

Payment Schedule: You will receive payment for your sales 48-72 hours upon the package's delivery to the buyer. This will initially show as a credit in your Anina account, which you can then cash out.

Seller Responsibilities:

Brands on Anina are responsible for:

  • Shipping products in a timely manner.
  • Providing accurate and comprehensive product descriptions.
  • Managing customer inquiries and support related to their specific sales.

Shipping:

We partner with DHL to ensure your order is delivered safely and securely. After you complete your sale, Anina will create a prepaid shipping label so you can ship your item hassle-free. All labels come with tracking to help provide you and the buyers peace of mind while your order is in transit.

Seller Content:

Brands are permitted to upload various types of content, including images, videos, and text descriptions, to showcase their products. While Anina has the rights to use and distribute this content for the purpose of operating and promoting the marketplace, the intellectual property rights to the content remain with the Brand. By uploading content, you grant Anina a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the content in connection with the Website and Anina's business.

Legal Compliance (for Brands):

Brands are expected to comply with all applicable laws and regulations related to sales, product responsibility, consumer protection, and any other relevant legal requirements in their country of origin and in the countries where they sell products.

Account Termination:

Anina reserves the right to suspend or terminate a Brand's account under certain circumstances, including but not limited to: Failure to process shipments in a timely manner. Lack of clear communication with buyers or Anina. Consistent poor product reviews or customer feedback. Violation of any part of these Terms or applicable laws.

Intellectual Property

All content on the Anina Website (excluding content uploaded by Brands, where the Brand retains primary ownership as detailed above), including text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of Anina or its content suppliers and protected by international copyright laws. The Brands retain all intellectual property rights to their individual products and the content they upload, granting Anina a license to use such content for the operation and promotion of the marketplace.

Data Privacy

Your privacy is paramount to us. Anina operates under a Global Privacy Policy, last updated on April 4, 2025. This policy explains how Anina collects, uses, and discloses your Personal Information when you use our Website. It details the types of data we collect (e.g., contact details, shipping addresses, payment information), why we collect it, how it's used for contract management, order processing, marketing (with consent), and legal compliance, and with whom it may be shared (e.g., group companies, service providers, legal bodies). We employ robust safeguards to protect your data, which is stored on our servers and retained as long as necessary for contractual and legal obligations. Global Legal Considerations

Governing Law and Jurisdiction:

These Terms and Conditions shall be governed by and construed in accordance with the laws of Mexico. While Anina operates globally, any legal disputes or actions arising out of or related to these Terms will be subject to the exclusive jurisdiction of the courts located in Mexico.

Updates to Terms:

Anina reserves the right to update or modify these Terms and Conditions at any time. We will notify Users and Brands of any changes by posting a prominent banner on the Website or by sending notifications to registered account email addresses. Your continued use of the Website after such modifications constitutes your acceptance of the revised Terms.

Disclaimer of Warranties and Limitation of Liability

Anina provides its platform "as is" and "as available." While we strive to offer a seamless experience, we do not warrant that the Website will be uninterrupted, error-free, or free of viruses or other harmful components.

Anina disclaims all responsibility and liability for:

  • The quality, safety, authenticity, or legality of products sold by third-party Brands on the marketplace.
  • Any interruptions or errors in the service.
  • Any issues related to product returns or refunds, as these are managed directly by the Brands according to their individual policies.
  • Any discrepancies between a product's description and its actual appearance or functionality. Users are solely responsible for carefully reading and understanding product descriptions provided by Brands before making a purchase.
  • Any acts or omissions of Brands, including but not limited to their compliance with shipping times or product quality.

Dispute Resolution

Currently, Anina does not offer a direct mediation service for disputes between Users and Brands. Users are encouraged to first contact the respective Brand for any product-related issues. If direct resolution is not possible, Users may escalate the issue through their payment provider.

Customer Service

Anina is responsible for providing customer service related to general account management, website functionality, and frequently asked questions. For any product-specific inquiries, shipping updates from the Brand, or issues directly related to an order, Users should first consult the Brand's information and policies.
